Terms & Conditions

3.1 Designated parking zone may or may not be allocated to Season Cardholder subject to the approval of the Car Park Operator, availability of parking bay and subject to the usage during normal weekdays only (excluding Saturday, Sundays and Public Holidays).
3.2 Unless stated otherwise, all Season Parker vehicles are only allowed to park at Basement Carpark Green, Orange and Blue Zones of Sunway Velocity Mall through Entry C (Access to B1 and Loading Bay only), Entry D, Entry E or Entry F (excluding Nesting parking).
3.3 Amount payable included the monthly or quarterly Season Parking Fee and any other amount payable in accordance with this Agreement including, but not limited to the Application Fee mentioned in the Schedule. Prior to the commencement date of parking, the Season Cardholder must pay to the Car Park Operator, in addition to the one-month advance parking fee and the amount of new card fee for first time application.
3.4 Provision of parking spaces for motor vehicles where parking charges are imposed under this Agreement are inclusive of government service tax or other taxes, levy by whatever name called as may be imposed by the appropriate authority all of which shall be borne and paid solely by the Season Cardholder.
3.5 Please do not send cash by mail. All payment should be made via bank transfer and official receipt will be issued after 3 working days.
3.6 The Car Park Operator reserve the right to introduce and revise any fees from time to time.
3.7 Parking fee has to be paid before the expiry of the card validation at the month or quarter end. Season card will be automatically barred and blocked to access on 1st day of each month or quarter if no payment received. The Season Cardholder will need to pay full month fee via bank transfer 3 working days before 30th of each month in order to unblock the access.
3.8 No refund of any unexpired on balance of parking fee upon early termination.
3.9 The season card is strictly non-transferrable and new card fees is non-refundable.
3.10 The Season Cardholder must pay the amount charged by the Car Park Operator for lost or damaged season card that due to Season Cardholder negligence which is equivalent to the new card fee.
3.11 The Car Park Operator reserves the right to block the card without providing any reason whatsoever.
3.12 The Agreement shall be automatically terminated upon 3 months from date of last use of card to enter or exit the car park and non-payment of the Season Parking Fee by the Season Cardholder.
3.13 A reactivation fee of RM 50.00 will be imposed for any immediate reapplication of terminated seasonal parking agreement of the same Applicant or vehicle registration number. The reactivation fee will be waived for reapplications after 3 months from the date of last termination.
3.14 The Season Cardholder must:
3.14.1 observe and conform to all the rules and regulations relating to the car park and issued by the Car Park Operator from time to time;
3.14.2 not use the car park and season card for any unlawful purpose and activity without the Car Park Operator authorization;
3.14.3 use the car park only during its operating hours;
3.15 The Season Cardholder will, if not in possession of a valid season card when entering or leaving the car park, be liable to pay the maximum normal daily parking tariff.
3.16 Vehicle is not allowed to park more than 24 hours in the car park. The Car Park Operator reserves the right to charge RM100.00 per day as storage fee and/or to remove the vehicle at its own discretion and shall not be accountable or liable to the owner as a result thereof.
3.17 No employee, agent or contractor of the Car Park Operator has authority to accept any goods for safe custody and the Car Park Operator will not be liable in any case for any loss of or damage to any article alleged to have been left with the Car Park Operator or any employee, agent or contractor for safe custody regardless of how that loss or damage is caused.
3.18 Neither the owner of the property nor the Car Park Operator shall be responsible or liable for any loss of life, personal injury, and/or loss or damage to vehicle, property and belongings arising from the use of the car park. Motor vehicles parked in the car park and property left in the vehicle are at the risk of the vehicle’s owner.
3.19 The Car Park Operator may terminate this agreement or revise these terms and/or modify or discontinue any information or features at any time, with or without notice, and without liability.
3.20 The Season Cardholder is bound by the Terms and Conditions throughout the contract period. Any revised of the Terms & Conditions will be display at the car park entrance.
3.21 No time or other indulgence granted by the Car Park Operator to the Season Cardholder will constitute a waiver of any of its right under Agreement or at law and the Car Park Operator will not be precluded from exercising any such rights against the Season Cardholder.
3.22 This Agreement is personal to the Season Cardholder and the Season Cardholder must not assign any rights or obligations under this Agreement without the prior written consent of the Car Park Operator.
3.23 Personal Data Protection - The protection of personal data is an important concern to the Car Park Operator and any personal data collected on this form will be treated in accordance with the Personal Data Protection Notice of the Company [https://www.sunway.com.my/privacy-notice/].
3.24 The Car Park Operator assumes no responsibility for any non-delivery of notices of bills, statements, reminders and/or any communication. All notices for bills, statements and/or reminders and/or any communication shall be deemed to have been duly delivered via email in any of the following manners:
3.24.1 Car Park Operator will register the Season Parker’s given email address on record, and noting that the email has been sent out without any delivery failure notification.
3.24.2 Season Parker must communicate with the email address which they have registered with the Car Park Operator.
3.24.3 Season Parker is advised to check his/her inbox (including Junk/Spam box) for any emails sent by the Car Park Operator regularly.
3.24.4 Season Parker must immediately notify the Car Park Operator if there are any changes to their email address.
